INJURY LAWYER SERVICES AND FEES

The law provides for compensation payment to victims of accidents and injuries, but there are pitfalls. Having lawyer advice and representation can avoid these pitfalls.

  1. Professional Experience: The injury lawyer has professional experience and know-how in effectively dealing with the liability insurance company. The lawyer's knowledge, experience and professional know-how are the tools for accomplishing the best results.

  2. Peace of Mind: The advantages of an experienced lawyer on your side includes providing you the peace of mind from regular follow-up communication to keep you advised of developments and progress. People have more than enough concerns in trying to cope with their injuries.

  3. Trust and Confidence: The most important consideration in selecting a lawyer is to have a comfortable and professional lawyer-client relationship that is built on trust and confidence. A solid foundation for a successful result begins with such a relationship.

  4. Qualifications: In selecting and hiring a personal injury lawyer, a person should consider the lawyer's experience, professional reputation, and the reasonableness of the proposed fee agreement.

  5. Reasonable Fees: In a personal injury or wrongful death claim, usually a reasonable contingent fee is the best choice for the client. What fee percentage is reasonable may be different for different cases. It depends upon all the circumstances related to the claim, including the difficulties, total dollar amount and lawyer work required to accomplish results. Contingent means that there is no fee unless and until money is collected. Part of the money is used to pay the lawyer a reasonable fee for the work. If there is no collection, there is no fee. As part of a retainer agreement, you should also reach agreement on how costs and expenses are handled. Frequently the lawyer will advance pay the claim processing costs and expenses for the client and be reimbursed upon a settlement as an additional amount after fees are calculated. All of this attorney/client arrangement and relationship is subject to a negotiated agreement which should be spelled out in writing, reviewed, and signed by a lawyer and the client. In my experience, lawyer effort and preparation of a claim will appropriately increase the fair compensation received by the client even after a reasonable attorney fee is paid from the money collected. Simply stated, good results are obtained by knowledge, skill, and effort.
